01. Acceptance of Terms

By accessing or using the LeaseAlert platform ("Service"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you may not use the Service. LeaseAlert provides an automated notification system for residential real estate listings in New York City based on user-defined criteria.

02. Description of Service

LeaseAlert is an independent notification tool. We are not a real estate broker, landlord, or property manager. We do not:

  • Represent any parties in a real estate transaction.
  • Verify the accuracy or availability of listings sent via our alerts.
  • Guarantee that a user will successfully secure a lease through our notifications.

03. Communication Services (Email & SMS)

LeaseAlert utilizes high-volume delivery services, including Amazon SES, to provide real-time updates. By enabling alerts, you agree to the following:

Email Alerts

Consent & Opt-In: Emails are sent strictly to users who have registered a verified account via AWS Cognito and explicitly created an "Active Search" with email notifications enabled.

Automated Suppression: To maintain platform integrity and high deliverability, LeaseAlert employs an automated feedback loop. If a notification to your provided email address results in a "Permanent Bounce" or a "Spam Complaint," our system will automatically flag your account as "Suppressed" and halt all future outgoing communications until the issue is resolved by the user.

Unsubscribe: You may opt-out at any time by clicking the "Unsubscribe" link in any email or by adjusting your settings in the Account Dashboard.

SMS Notifications

  • Consent: By opting into SMS, you provide express written consent to receive automated messages.
  • Frequency: Message frequency depends on market activity and search criteria.
  • Rates: Standard message and data rates may apply from your carrier.
  • Opt-Out: Text STOP to cancel at any time. A confirmation message will be sent.
  • Help: Text HELP for assistance or email support@lease-alert.com.

04. User Responsibilities

As a user of LeaseAlert, you agree to:

  • Provide accurate contact information and maintain the security of your account.
  • Not use the service for any illegal or unauthorized purposes.
  • Not attempt to "scrape" or bypass the automated systems of the platform.
  • Acknowledge that listing data is sourced from third parties and may contain errors.

05. Limitation of Liability

To the maximum extent permitted by law, LeaseAlert shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the listing notification system.

06. Intellectual Property

The LeaseAlert name, logo, and all original software and code are the exclusive property of LeaseAlert and are protected by copyright, trademark, and other laws of the United States.

07. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

08. Third-Party Analytics & Cookies

We use third-party analytics tools, such as Google Analytics, to help us understand how users interact with our Service. These tools use cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends.

By using LeaseAlert, you acknowledge and consent to the processing of data about your site interactions by these providers. For more details on how this data is managed, please refer to our Privacy Policy.

Termination

We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
